Cities are adopting predictive systems designed to identify emerging hotspots, optimize patrol allocation, and support data-driven policymaking. While these tools offer substantial potential benefits, they also introduce governance and legal challenges far beyond those raised by traditional, rule-based software. AIโ€™s opacity, complexity, reliance on historical data, and probabilistic reasoning make it difficult to assess, audit, and justify government decisions influenced by algorithmic outputs. This case study examines the use of predictive policing in a mid-sized city and demonstrates why governments need a comprehensive AI governance framework before deploying similar systems.

Over time, users may become overly reliant on these outputs, effectively transferring discretionary authority to systems that lack legal accountability. Compounding the problem is the speed and scale at which AI can analyze data and propagate updates. A flawed assumption or bias baked into a model can spread across an entire police departmentโ€™s operational footprint in hours, far faster than oversight bodies can respond.

Furthermore, AI is deeply data-dependent. Predictive models are only as reliable as the data on which they are trained, and historical arrest records frequently reflect long-standing enforcement patterns rather than unbiased indicators of actual criminal activity. When these datasets are used uncritically, AI systems risk amplifying historical disparities. Because AI operates on probabilistic outputs, its forecasts represent likelihoods rather than certainties and lack the contextual nuance that human analysts typically apply. When such probabilistic predictions drive resource allocation or enforcement decisions, they can produce real-world harms, particularly for communities that already experience disproportionate policing. This creates heightened risk for misuse or unintended harm, raising legal concerns under equal-protection, disparate-impact, and administrative-law frameworks.

The complexity and opacity of the model prevent meaningful oversight, limiting the cityโ€™s ability to justify or challenge its outputs.

Over time, the system assumes greater autonomy. Patrol commanders begin relying on its recommendations, using them as the primary basis for daily deployment decisions. When discrepancies or errors arise, determining responsibility becomes difficult: were outcomes driven by human discretion or by algorithmic influence?

Because the system updates every day, its influence scales rapidly. Even minor biases in the training data become magnified as the model recalibrates and reshapes enforcement patterns city-wide. This illustrates the combined effects of speed, scale, and data dependency. Historical arrest data, often reflecting over-policing in certain neighborhoods, leads the model to repeatedly designate those same areas as high-risk. Increased patrol presence then produces more arrests, reinforcing the very data that trained the system and creating a self-perpetuating feedback loop.

Communities experience the consequences of AIโ€™s probabilistic reasoning most acutely. The model predicts likelihoods of crime without context such as community events, economic changes, or social-service interventions. Yet these probabilistic forecasts result in tangible outcomes: heightened police presence, increased stops, and expanded surveillance, even where actual crime rates remain stable. This dynamic erodes public trust and exposes the city to legal risks, including claims based on disparate impact, equal protection, transparency violations, and improper delegation of governmental authority.

Community participation, especially from neighborhoods disproportionately affected by predictive enforcement, should be integrated into design, review, and oversight processes.

Most critically, agencies must preserve meaningful human judgment. Clear policies should define when AI may inform decisions and when reliance is prohibited, particularly for liberty-impacting actions such as arrests or charging decisions. Roles, responsibilities, and accountability pathways must be formally documented to avoid ambiguity when AI-influenced decisions lead to harm.

These governance practices align with emerging global frameworks such as the NIST AI Risk Management Framework, ISO/IEC 42001, and the EU AI Actโ€™s high-risk system requirements. As AI becomes more common in public-sector decision-making, adopting these safeguards will be critical not only for legal compliance but also for maintaining public trust in the legitimacy of AI-enabled policing.
