That’s the effective date for the groundbreaking Colorado Artificial Intelligence Act (CAIA), and it’s imperative that your company determine its obligations and begin preparing for compliance now.
The CAIA is significant because it’s the first comprehensive state-level AI law in the U.S. and is likely to influence legislation in other states. Its core purpose is to protect consumers from “algorithmic discrimination” arising from the use of “high-risk artificial intelligence systems.” This means businesses using AI that makes “consequential decisions” β those with a “material legal or similarly significant effect” on consumers β will be subject to its provisions.

The CAIA imposes a “duty of reasonable care” on both developers and deployers to protect consumers from known or reasonably foreseeable risks of algorithmic discrimination. This isn’t a vague suggestion; it comes with concrete requirements, including:
- Risk Management Policies and Programs: You’ll need to establish and maintain robust policies and programs to identify, document, and mitigate risks of algorithmic discrimination.
- Impact Assessments: For deployers, conducting annual impact assessments of high-risk AI systems is mandatory, and these must be retained for at least three years.
- Transparency and Disclosure: Both developers and deployers will have significant disclosure obligations, including public statements about how algorithmic discrimination risks are managed, and notifications to consumers when high-risk AI systems are used in consequential decisions.
- Data Governance: Understanding the types of data used to train high-risk AI systems and their potential limitations is crucial.
- Consumer Rights: The law grants consumers certain rights, including the opportunity to appeal adverse decisions made by high-risk AI systems and to correct inaccurate personal data used in such decisions.
- Cooperation with the Attorney General: The Colorado Attorney General has exclusive authority to enforce the Act, and violations are considered unfair trade practices, carrying potential civil penalties of up to $20,000 per violation.
