The rapid adoption of Artificial Intelligence (AI) is creating novel and complex data privacy and security challenges that traditional governance frameworks were simply not designed to handle. Relying on outdated policies exposes organizations to regulatory risk, especially under comprehensive laws like the GDPR and CCPA.

AI introduces unique risk vectors such as inferencing (deriving new, sensitive data points), reidentification of “anonymized” records, and model leakage (where the training data can be reverse-engineered). Therefore, a focused evaluation and strategic update of existing data privacy and security policies is not just a best practice—it’s necessary.

Here is a breakdown of the key areas an organization should evaluate and the corresponding update strategies to policies adjusting for AI.

Limit the use of special category or Sensitive Personal Information data unless explicitly justified, strictly necessary, and robustly protected.
Security & Confidentiality New threats targeting the AI model and its data inputs/outputs. Assess threats like model inversion, membership inference, and data leakage. Update security controls (e.g., encryption, access controls) specifically for both the training and inference stages.
Data Subject Rights (DSARs) Exercising rights against data used to train and operate AI models. Ensure data subjects can exercise rights (access, deletion, objection) even when their data has been used in model training. Implement mechanisms for responding to DSARs that involve AI-generated insights.

AI Transparency The need to explain automated decisions. Update privacy notices to include explanations of automated decision-making (e.g., GDPR Art. 13–15). Include meaningful information about the logic and foreseeable consequences of profiling.
Vendor & Third-Party Use Risk of data being re-used by vendors without customer knowledge. Update contracts to include limitations on re-use of customer data for vendor AI training. Require transparency from vendors about how they use customer data in their AI systems.

🧩 The Core Principle: Addressing Novel AI Risks

The foundational problem is that AI systems inherently present novel data risks. For example, a large language model (LLM) trained on personal data can “memorize” and later reveal that data, or it can be used to infer highly sensitive personal traits. Without explicit provisions covering model transparency, data governance across the entire model lifecycle, and procedures for responding to new AI-specific threats, an organization’s policy framework remains dangerously incomplete.
