Initially, when beginning your business, you may need to clear the availability of the domain name you plan on operating under. Just because a domain name is available for registration or purchase from a third party does not mean that there cannot be a third party that has rights to prevent your use of the domain name. So, pre-clearance can be an important first step.
If someone else is using a confusingly similar name as yours, otherwise marketing or advertising in a manner that infringes your trademark, or if you are accused of such actions by someone else, then we can assist you in these actions. The primary forums for domain name disputes are (1) ICANN’s Uniform Domain Name Dispute Resolution Policy (UDRP), and (2) through the federal courts. Prosecuting through the UDRP process is usually a lot less expensive and faster than going through the courts. Under certain circumstances actions under the Anticybersquatting Consumer Protection Act (ACPA) will be available to trademark holders.
